What are your rates?
A. Our fees are calculated on a case by case basis. We do require a retainer before we initiate any investigative, or technical services.
Will you testify in court?
A. We work every case under the notion that it will end up in court. Many good cases can turn into a disaster if someone has difficulty testifying in court. For TSCM Investigators, providing testimony is never a problem or difficult. Remember, previous clients have hired us because we aggressively attempt to obtain facts, and testify in court about the facts obtained. Our facts are verified with video documentation.
Can you sell me cell phone records?
A. No. A new federal law went into effect in
2007 that makes it illegal to obtain someone else's cell phone records. If you
need cell phone records, please consult with competent legal counsel.
On January 12th 2007 President Bush signed H.R. 4709 The Telephone Records and
Privacy Protection Act of 2006. It is now illegal to sell, transfer, or possess
confidential phone records. Confidential phone records are defined in the act
as: information relating to the the quantity, technical configuration, type,
destination, location, or amount of use of a service offered by
a phone company.
The Telephone Records and Privacy Protection
Act of 2006 also includes an "Extraterritorial Jurisdiction" clause which
prohibits foreign companies from selling or reselling any telephone records.
Is everything you do confidential?
A. Yes. But, If a court orders us to provide information relevant to an investigation, we must comply. Anything we discuss with your attorney is considered confidential under TN Rules of Court under investigator/attorney privileges, IF your attorney retained us or referred you to us
Do you charge for consultation?
A. No. Initial consultations are free by phone, or if you visit our office.
What type of information will you provide me with?
A. Facts and the truth. All surveillance is documented with video tape of all activity. Copies of data pulled will be provided to you or your attorney with regard to privacy laws. Written reports will be provided upon request or when deemed necessary for your case.
If you don't get anything do I have to pay?
A. We would not accept your case if we knew the probability of obtaining results would be minimal. We do not work on a contingent basis
I can't afford you, but I need your help, can you help me?
A. We occasionally accept pro bono cases during the course of the year. Pro Bono cases are accepted on a case by cases basis. We do not provide pro bono services for child custody or divorce cases. If you would like to schedule a meeting with us, we may be able to provide you with some ideas to help you. We are not a law firm, and do not provide legal advice.
I retained a PI to work my case, they did nothing, would not provide me with anything, and would not refund my money. What can I do?
A. We have reworked many cases that others have worked. The law says you are entitled to a written report if you are a client in good standing, (that means paid up). If you have been receiving what you feel is substandard service, contact us and we will review what you have and advise accordingly.
I want to shoot my own video, and work my own case, but I have been told this is not good, Why?
A. A licensed investigator has the right to perform surveillance, and run an investigation. Working your own case may cause your opposition to file stalking charges against you and more. There are laws and guidelines that need to be followed when working an investigation. There are things the courts will accept and wont accept. Knowledge of evidence handling, and rules of court, will be known by a competent investigator. Providing information that may cause self inflicted damage to your case is not a good option. A good analogy is of one trying to perform their own surgery or dental work. Some things are best left to professionals.
